If you are on foot and don't have a hog it is perfectly legal to nade any enemy hog, assuming you do not camp or break any of the other racing rules. From your description of map start, it is completely fine to nade certain targets at the front of the spawn. If you have a hog, and the person getting into a hog in front of you is by themselves it is better to let them go, as you both have a hog and can race. Like you said they are no threat. If their a two enemies in the same hog in front of you, they are a threat as the gunner will obviously swivel on the gun and turn to target you. In that case you are under threat and you can nade.

Basically the only threat you should throw nades to defend yourself with is the imminent threat of death. You should not nade hogs when you have hogs present, even if they are going to score laps, unless of course they are attacking you.
